General information
Welcome to Z900Build. In this document, “Z900Build”, “we”, “us” and “our” refer to the online store operating at z900build.com. Z900Build makes this store and this website available to you, including all related information, content, features, tools, products and services (the “Services”). The store is powered by Shopify, which is the platform that enables us to provide you with the Services.
These terms and conditions, together with the policies they refer to (the “Terms”), describe your rights and responsibilities when you use the Services.
Please read them carefully: they contain important information about warranties, disclaimer of liability and limitation of liability.
By visiting, interacting with or using our Services you agree to be bound by these Terms and by our Privacy policy. If you do not agree with them, do not use the Services.
Nothing in these Terms limits, replaces or makes conditional the rights that consumer protection law grants you as a consumer. In the event of any conflict between these Terms and that law, the law shall always prevail.
1. Access and account
By accepting these Terms you declare that you are of legal age in your country of residence, or that you have the consent of the person who holds legal guardianship over you.
To use the Services, including the purchase of any product, you may need to provide certain information, such as your email address and your billing, payment and shipping details. You represent that the information you provide is accurate, up to date and complete, and that you have the right to provide it.
You are solely responsible for keeping your account credentials secure and for the activity carried out from your account. You may not transfer, sell, assign or license your account to another person.
2. Our products
We do everything we can to display our products accurately. Please bear in mind, however, that colours and finishes may look different depending on the screen and the settings of the device you use.
Product descriptions and listings may be updated at any time. We reserve the right to discontinue any product and to limit the quantities available per person or per geographic area.
The products we sell are non-original customisation parts and accessories (“aftermarket”). They are not manufactured or distributed by Kawasaki. References to motorcycle brands, models and years are made solely for the purpose of indicating the compatibility of the part.
Some customisation parts may be subject to type-approval or certification requirements in order to be used on public roads, and those requirements vary from country to country. Before purchasing and installing any part, check the rules applicable in your place of residence. Where we have specific information about the type-approval or certification of a particular product, we will state it on its product page.
3. Orders
When you place an order you are making an offer to purchase. We reserve the right to accept or reject it. The order is not deemed accepted until we confirm it to you, and we must have received and processed payment.
Review your order carefully before confirming it: once it has been accepted, we may not be able to act on a cancellation request. If we do not accept, if we amend or if we cancel an order, we will try to notify you by email or through the contact details you have provided to us.
You may withdraw from your purchase and return the products under the conditions described in our Refund policy, which sets out both your legal rights and our commercial 30-day return policy. That policy is the one that governs returns, and it does not restrict the rights granted to you by law.
We work with external suppliers who ship the products directly, which is why we do not publish a fixed return address: the correct address depends on the supplier and on the specific product. To return an item, write to us first at info@z900build.com with your order number and we will give you the corresponding instructions and address. We do not accept returned parcels where the return has not been requested beforehand, because without the supplier’s instructions the parcel may be lost.
Our products are offered for personal use. If you wish to place an order for resale or commercial distribution, write to us first at info@z900build.com.
4. Prices, taxes and billing
Prices, discounts and promotions may change without prior notice. The price applicable to your purchase is the one in force at the time you place the order, and it is the one shown in the confirmation you receive by email.
The prices displayed in the store include applicable taxes. Shipping costs are calculated and shown separately during checkout, before you confirm the purchase, as set out in our Shipping policy.
We sell to different countries and markets. Depending on the delivery country you select, prices may be displayed in your local currency through automatic conversion, and the final amount may vary slightly because of the exchange rate and the rounding applied by the platform at the time of payment. The amount charged to you is always the one displayed on the payment screen before you confirm.
For shipments outside the European Union, customs duties or import taxes may apply in accordance with the rules of the destination country. What we know about this is set out in detail in our Shipping policy.
You agree to provide truthful, complete and up-to-date purchase and payment information, and to keep it current so that we can complete the transaction and communicate with you. You represent that you are authorised to use the payment method you employ.
5. Shipping and delivery
The delivery times we indicate are estimates based on our experience and on carrier information. They are not guaranteed timeframes and may be affected by carrier incidents, customs procedures, high-demand periods or local public holidays.
If your order is delayed beyond the estimated timeframe, if tracking stops updating or if the parcel arrives damaged, write to us at info@z900build.com with your order number and we will look into it with you, as described in our Shipping policy.
The risk of loss of or damage to the products passes at the moment when you, or a person designated by you other than the carrier, acquires physical possession of the products.
All orders are shipped with a tracking number. We send it to you by email as soon as the order leaves, and you can check it at any time on our tracking page.
6. Intellectual property
The Services, including the texts, images, graphics, photographs, videos, audio, product reviews and the design, selection and arrangement of all of them, are owned by Z900Build or by its licensors, and are protected by applicable intellectual and industrial property law.
These Terms allow you to use the Services for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit any material from the Services without our prior written consent. Except as expressly provided, nothing in these Terms grants you any licence over trade marks, copyright or other intellectual property of Z900Build, of Shopify or of third parties.
The Z900Build name, logo, product names, designs and slogans are distinctive signs of Z900Build. You may not use them without our prior written permission. “Shopify” and its distinctive signs belong to Shopify. All other names and marks appearing in the Services belong to their respective owners.
7. Third-party tools
Through the Services you may gain access to tools offered by third parties that we neither control nor monitor.
You acknowledge that access to those tools is offered “as is” and “as available”, without warranties of any kind on our part. Your use of them is at your own risk, and you must review and accept the terms of the relevant third party.
We may add new features and tools in the future. They will also form part of the Services and will be subject to these Terms.
8. Links to third-party sites
The Services may contain links to, or embedded content from, websites operated by third parties. We are not responsible for reviewing or assessing their content or accuracy. If you decide to access them, you do so at your own risk.
Review that third party’s policies and practices before entering into any transaction with it. Claims or questions about third-party products and services must be addressed to that third party.
9. Relationship with Shopify
Z900Build is powered by Shopify, which is the platform that enables us to provide you with the Services. However, any sale or purchase you make in our store is made directly with Z900Build. By using the Services you acknowledge and agree that Shopify is not responsible for any aspect of the sales between you and Z900Build, including any damage or loss arising from the purchase of products and services. You hereby expressly release Shopify and its affiliates from any claim, damage and liability arising out of your purchase and transaction with Z900Build.
10. Data protection
The processing of the personal data we collect through the Services is described in our Privacy policy. Certain personal information may additionally be subject to Shopify’s privacy policy. By using the Services you acknowledge that you have read our Privacy policy.
Since the Services are hosted by Shopify, Shopify collects and processes information about your access to and use of the Services in order to provide and improve them. The information you submit to the Services will be transmitted to and shared with Shopify and with the providers needed to deliver the service to you, some of whom may be located in a country other than the one in which you reside. See our Privacy policy for the details.
11. Reviews and content you send us
If you send or post ideas, suggestions, comments, reviews, photographs, videos or other content to us (the “Content”), you grant us a worldwide, non-exclusive, royalty-free and sublicensable licence to use, reproduce, adapt, publish, distribute and display it in any medium, including the promotion of the store and of its products.
You represent that: (i) you hold the necessary rights over the Content; (ii) you have disclosed any compensation or incentive you have received in connection with it; and (iii) the Content complies with these Terms.
We are not obliged to keep the Content confidential, to pay for it or to respond to it. We may, without being obliged to do so, moderate, edit or remove Content that we consider unlawful, offensive, defamatory, obscene or contrary to these Terms or to third-party rights.
You agree that your Content will not infringe third-party rights, will not include malicious code and will not use a false identity. You are solely responsible for the Content you post and for its accuracy.
You may request the removal of a review or content you have posted at any time by writing to us at info@z900build.com.
12. Errors, inaccuracies and omissions
Published information may contain typographical errors, inaccuracies or omissions relating to descriptions, prices, promotions, shipping costs, timeframes or availability. We reserve the right to correct those errors and to update the information at any time.
If an error affects an order you have already placed — for example, a manifestly incorrect price or a product that is not actually available — we will let you know as soon as possible and you will be able either to confirm the order with the corrected information or to cancel it with a full refund.
13. Prohibited uses
You may access and use the Services only for lawful purposes. You may not use them, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to breach any applicable rule or law; (c) to infringe our intellectual property rights or those of third parties; (d) to harass, insult, defame, intimidate or harm any person; (e) to transmit false or misleading information; (f) to send unsolicited advertising, chain messages or similar bulk communications; (g) to impersonate another person or entity; or (h) for any other conduct that restricts other people’s use of the Services or that may harm Z900Build, Shopify or their users.
You also agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, duplicate, copy, extract, sell or exploit any part of the Services; (c) collect other people’s personal data; (d) engage in phishing or impersonation practices; (e) use robots, spiders, scraping, data extraction tools, artificial intelligence systems or other automated means to access the Services; or (f) circumvent the security or access-restriction measures we employ.
We may suspend or terminate your access if you breach these Terms.
14. Automated agents
14.1. This section applies if you use, permit or cause an Agent to access or interact with the Services. “Agent” means any software or service that carries out autonomous or semi-autonomous actions on behalf of, or at the instruction of, a person or entity, and that may run without direct supervision.
14.2. No Agent may access or interact with the Services unless it identifies itself and operates in strict compliance with clause 14.4. Nor may it do so if we have asked it to refrain.
14.3. We may limit, including by technical measures, the access and interaction of any Agent with the Services.
14.4. Agents must: (i) identify themselves in every HTTP/HTTPS request by stating in the user-agent field that the request comes from an Agent and disclosing its name, in the format Agent/agent-name; (ii) not conceal or create confusion about the fact that the access comes from an Agent, whether by imitating human behaviour or by completing or circumventing CAPTCHA or other measures intended to distinguish human use from automated use; (iii) respond truthfully to any check intended to determine whether the interaction comes from a human or from an automated system; and (iv) not circumvent measures intended to block, limit or control Agent access.
15. Term and termination
We may terminate this agreement or suspend your access to the Services, in whole or in part, in the event of a breach of these Terms. You will remain liable for the amounts accrued up to the date of termination.
Termination does not affect orders already accepted, nor the return and warranty rights to which you are entitled in respect of products already purchased.
The sections relating to intellectual property, content, disclaimer of warranties, limitation of liability, indemnification, severability, waiver, entire agreement, assignment, governing law and data protection will continue to apply after termination, as will any other provision that by its nature ought to survive.
16. Disclaimer of warranties
The information published in the Services is provided for general informational purposes. We do not warrant that it is accurate, complete or useful in every case, and any reliance you place on it is at your own responsibility.
Unless expressly stated otherwise, the Services are provided “as is” and “as available”, without warranties or conditions of any kind, express or implied, including those of merchantability, satisfactory quality, fitness for a particular purpose, durability, title and non-infringement. We do not warrant that your use of the Services will be uninterrupted, timely, secure or error-free.
This disclaimer relates to the operation of the website and of the Services, and in no case does it affect the legal guarantee of conformity of the products or the other rights that consumer protection law grants you, described in our Refund policy.
17. Limitation of liability
To the maximum extent permitted by law, Z900Build, its partners, service providers and licensors, as well as Shopify and its affiliates, shall not be liable for indirect, incidental, special, punitive or consequential damages of any kind, including loss of profits, loss of revenue, loss of data or the cost of replacement, arising from the use of the Services or of any product purchased through them.
This limitation does not exclude or limit our liability for wilful misconduct, gross negligence, personal injury, or any other liability that cannot be excluded under applicable law, including liability arising from the legal guarantee on products and from product liability legislation.
Installation of the products is carried out at the risk of the person performing it. Z900Build does not carry out, supervise or take part in the installation. We recommend that parts affecting the safety, lighting, braking or structure of the motorcycle be fitted by a professional workshop.
Offering a product for sale does not constitute any representation or warranty as to its suitability for use on public roads, a matter which must be verified by the person installing it in accordance with the rules of their country. The foregoing does not affect the legal guarantee of conformity where the product has a defect attributable to us.
18. Indemnification
You agree to hold Z900Build, Shopify and their respective partners and providers harmless against third-party claims, including reasonable defence costs, arising from (1) your breach of these Terms, (2) your infringement of any rule or of third-party rights, or (3) your access to and use of the Services.
We will notify you of any claim covered by this clause. We may conduct the defence of the claim, although we will not enter into settlements imposing non-monetary obligations on you without your consent, which will not be withheld without good reason.
This clause does not apply to consumers to the extent that applicable consumer protection law prevents it.
19. Severability
If any provision of these Terms is held to be unlawful, void or unenforceable, it will apply to the maximum extent permitted by law and, to the extent it is not applicable, it will be deemed not to have been included, without this affecting the validity of the remaining provisions.
20. Waiver and entire agreement
Our failure to exercise a right provided for in these Terms does not amount to a waiver of that right.
These Terms, together with the policies published in this store, constitute the entire agreement between you and us regarding the use of the Services, and supersede any prior agreement or communication on the same subject matter, including previous versions of these Terms.
21. Assignment
You may not assign or transfer this agreement, nor the rights and obligations arising from it, without our prior written consent. We may assign or transfer these Terms in the context of a reorganisation or transfer of the business, without this reducing the rights to which you are entitled.
22. Governing law and complaints
These Terms and the purchases made through the Services are governed by the law applicable to distance selling and to consumer protection.
If you contract as a consumer resident in the European Union, you retain in every case the protection afforded to you by the mandatory provisions of the law of your country of residence, and those provisions are not affected by anything set out in these Terms.
Before starting any formal complaint, we ask you to write to us at info@z900build.com explaining what happened. Most issues are resolved directly, at no cost and within a few days.
23. Headings
The headings in this document are included solely to make it easier to read and do not affect the interpretation of these Terms.
24. Versions in other languages
These Terms may be available in several languages. Translations are provided to make them easier to understand. In the event of any discrepancy between versions, the Spanish version shall prevail, without prejudice to the rights granted to you by the law of your country of residence.
25. Changes to these Terms
You can consult the version of these Terms currently in force at any time on this page, together with its last updated date.
We may update or amend these Terms by publishing the new version on the website. We will inform you of substantial changes in accordance with applicable law, and those changes will take effect on the date indicated. Orders already placed are governed by the version of the Terms in force at the time of the order.
